Walang established na capital gains on crypto kasi mas malala (from the POV ng taxpayer) since it should form part of the non-operating income under other income and will be taxed based on the applicable tax bracket. Other income in my case kasi primary source ko ng income is business-related.
Kahit yung Hepe ng RDO kung saan ako nagreport ng crypto gains for the year ended 2024, ang terminology na ginamit nya “nanalo ka daw sa crypto” during our conversation. “Winnings” e subject to “final tax” pero wala din naman regarding crypto. Ang nangyari kasi yung staff nya na kausap ko the week before e naka leave nung usapan namin for me to return with additional docs for my intended purpose (BIR stamp for my AITR). Not sure kung paano kinuwento nung staff (na mas aware sa crypto) dun sa Hepe (older gen) kung bakit “nanalo sa crypto” ang term.
Kung taxing authority mismo hindi malinaw ang understanding sa crypto, mahirap din sa side ng taxpayers. Hindi lang for 2024 filing yung conversation ko with BIR regarding crypto. Kahit nung 2022 filing na nasa ibang RDO p ko naka map since I was still in Corpo back then, yung Officer of the Day na kausap ko that time is medyo ilag sa crypto-related advice / discussion.
But further into the topic, I think there are two (2) different issues ;
A) Tax evasion sa pagbayad ng capital gains on sale ng crypto, airdrops, staking rewards, etc. (which I doubt kung merong enumeration kung ano ang taxable event na specific to crypto)
B) Circumvention nung AMLA thresholds para hindi ma question or ma-flag or ma-freeze yung bank accounts. Ang hindi naiisip nung iba, yung covered transaction lang na-bypass nila. Kung magaling yung setup to detect suspicious transactions, kahit below threshold yan, kung may pattern detection, aggregation or kung ano mang automated system flag, bale-wala yang pag bypass.
